Who pays if a bicycle hits your car in Australia depends on who was at fault and what insurance each party has. Unlike car-to-car accidents, there is no compulsory third party property insurance for bicycles, so recovery can be more complicated. If the cyclist was at fault, for example they ran a red light, rode out of a lane, or hit your parked car, the cyclist is personally liable for the damage to your car. You can claim against them for repair costs. If the cyclist has third party liability insurance through Bicycle Network membership, AusCycling membership, or through specialist bicycle insurance like Velosure which includes liability cover, their insurer will pay. Many cyclists have this cover via Bicycle Network which provides up to $20M liability. If the cyclist has no insurance, you would need to pursue them personally for payment, which can be difficult. If you have comprehensive car insurance, your insurer will cover your car repairs minus your excess, and then your insurer may try to recover the cost from the cyclist through a letter of demand. If you were at fault, for example you opened a car door into a cyclist or turned across their path, you are liable for damage to their bike and their injuries, and your third party property or comprehensive car insurance will cover damage to their bike, while your compulsory third party CTP insurance will cover their personal injuries. Always exchange details and take photos, and report to police if injuries occur.
