As of late 2026, the Department of Homeland Security (DHS) has placed the rescission of H-4 employment authorization on its regulatory agenda as a long-term action item, but the H-4 EAD program has not been eliminated or removed. While the executive administration has signaled an intention to propose rules that would reverse the 2015 authorization allowing certain H-4 dependent spouses of H-1B workers to work, turning that agenda item into an active policy requires publishing a formal Notice of Proposed Rulemaking (NPRM), opening public comment periods, and surviving federal court scrutiny. Consequently, eligible H-4 visa holders can still legally apply for, hold, and renew their Employment Authorization Documents.
