Title insurance is not legally mandatory under provincial or federal legislation anywhere in Canada. However, while the law does not explicitly force property buyers to purchase a policy, virtually all major commercial banks and institutional mortgage lenders in Canada will refuse to finance a real estate purchase unless a valid title insurance policy is secured. Lenders insist on this requirement because it protects their financial security interest against hidden title defects, survey errors, and real estate fraud.
