Forcing a flatmate to leave a property in New Zealand depends entirely on their legal status and whether their name is on the master tenancy agreement. If the flatmate is not named on the lease and has no formal sub-tenancy agreement, they have very limited statutory protection under the Residential Tenancies Act. However, the head tenant or primary occupant still cannot use physical force, change locks unlawfully, or throw belongings out without warning; doing so can lead to civil legal liability and claims in the Disputes Tribunal.
